The DOD War Manual, states that 11.3 applies to both the Belligerent Occupier and the Occupied Territory (the United States).
According to the manual, after one year of Occupation, the GC obligation will expire.

Therefore, 1/20/2022, will be one year since China and the Biden Administration took over and became a Belligerent Occupier.
After this date, 11.3 will go into effect and the military then has the legal right to take over the country.

According to the Law of War manual the illegitimate government has to be in power for a year before the military can lawfully remove them. A year that would be January 21st.
